I would put a catch up agreement in writing and have her sign it, but I would file for eviction the second she did not execute on her end of the agreement.

If the target property was owned by an LLC of which your family member was the only member and it did not file it's own tax return, then even though the LLC is on the deed it would be "disregarded" by the IRS.

Your lease should say this.I would tell them that they are forcing you to file an eviction which will show up on their credit report if they don't come up with a plan to pay all money owed.
