I remember 10 years ago, I would fly out to Irvine from Chicago every phase release in the Casalon development in Quail Hill. 3bed / 3.5 bath 1600 sq/ft townhome were selling in the $350s in the first phase and each phase went to $30k by 2004 hit.

Then the tenant buyer for 3% of the purchase price places a check into escrow, check paid to escrow coI have a new separate agreement that both the seller and the new tenant buyer sign that allows me to collect 3% for an option release fee, an option release agreement.A new lease and the new option is created for the seller and the new tenant buyer.

@Jay Dean  In order to sell via a LO in TX, you as the owner must have fee simple title, which I have to assume you do, since that is how we hold title in TX.If you have a mortgage, you will need to give the TB the mortgage information, as well as send the lien holder an Auth to Release info form so the buyer can confirm the mortgage info.

In fact, it will be required as the private lender will need to release their security over the property.If you're using another line of credit (e.g., business loan) to pay off the private lender, that's typically fine too, although you just want to double check the terms of the line of credit and be mindful of things like not using one LLC's line of credit to pay off another LLC's debt.

You could say "This obligation is made on a NON-RECOURSE basis and the maker(s) hereof are hereby released of any and all personal liability and obligation for the repayment of amounts due as well as to any deficiency amounts outstanding after any sale of the collateral secured."
