The reality is that the plaintiff will have to prove that a Member of an LLC willingly & knowingly engaged in fraud or other illegal activity in order to proceed with that person as a party to the suit.

@Caroline Gerardo my general approach in these situations is to not engage further.

It's hard to believe that so many people would be openly engaging in something that is illegal.  

A legitimate broker doesn't get to decide if a seller cares or not - He engages in full disclosure.That's my main issue is you guys are not honest (nor ethical) and refuse to disclose anything that may make them look bad. 

Engaging in a cost segregation study to capture bonus depreciation can indeed have potential benefits, especially considering your investment goals and timeline.
