I went back and pulled old permits and other supporting materials and ended up getting a "non-enforeceable, non-confirming" letter sating it could stay the way it was. 

Be polite, stick to the facts and if the comps you pulled support your numbers, they will need to counter with comps that support their numbers.

If your investments can't support the price of someone else doing the work then they may not have been the best choices for passive investments.If you are just starting out and are trying to maximize the cash flow to get established then I can understand that.Apartment complexes have a higher turnover.

They are very supportive of this bill and I could see it being voted on tomorrow or Friday possibly.

I think he was being dramatic.  40% taxes would drive away all investors and would certainly not have political support.
