These are tax-deferred vehicles, however UBIT would apply on leveraged portion of a property in an IRA (again, 401k would be exempt).Passive income inside of either IRA or 401k would be sheltered from taxes, business income inside of both IRA and 401k would be subject to UBIT.

You are not in such bad shape if a balcony rail breaks and your tenant dies hitting the concrete sidewalk, but if you are hit with some sort of sexual lawsuit, retaliation,  harassment, or discrimination then you are getting sued, personally, not your insurance company and you have to pay the attorney fees from your pocket to defend yourself unless you have inclusions in your policy for those types of lawsuits.
