While you are free to ask advice of other landlords there is no substitute for knowing the actual law.Add some sort of clause in your lease that entitles you to reasonable attorney fees and court costs in the event of legal action.You sound rather inexperienced as a landlord regarding evictions and deposits.

You give the QI the amount of cash that would have been deposited to your exchange escrow if you had received all cash for your relinquished property.Once you have substituted your cash for the note, the QI assigns the note to you outside of the exchange window so that you avoid constructive receipt of exchange proceeds.

When I visit them originally I try to get a copy of their most recent statement and look at the original note and DOT before I spend too much time on the phone goofing with the bank.Nothing substitutes for calling the servicer and speaking to them directly though.
