Maybe.. you will need a notarized permission from the owner to talk to the foreclosing company or bank.present your offer and see what they do.. its a little late.. when I dealt with this stuff I just cashed out the bankas in they will accept all cash.. but they wont postpone the sale you need to get your money there the day before the sale .. it also helps if its a listed property..

Ask the nephew if he could sign a notarized statement that tells of the father passing, never married, only the identified children by name and date of birth/death (for those deceased), and the names, date of birth/death (if any are deceased) for the children of the deceased siblings.

I can't count the number of times we were surveying a property that looks like it has an encroachment based on the record deed, only to have the neighbor bring out a notarized sale agreement that was never recorded simply because they did it themselves without benefit of a survey or legal counsel.

I have a tenant with first, last and security deposit on hand and is willing to get her mother to sign a notarized statement that she provides for her daughter and helps with her bills that is the good news the bad news is her income is low as compared to the rent, basically her income is about the same as the rent.

When it is not possible to talk to the legal owner of the property, a notarized Purchase and Sale agreement will verify that the person claiming to be the owner of record, at least presented identification documents at the time of signing.
