@Mandy Seley the way I personally handle this is to give all interested applicants a paper (Google Docs) application via email.

Same with a roof, if you replace it because it is leaking, that's a repair.

I’m set to close on a property tomorrow morning and upon a final walk through today to check if all items noted on inspection report had been completed we noticed that not only had the items not been addressed but there was also a water leak coming from the roof.

You need to read the hoa docs and realize that once the actual homeowners take over from the builder, they may likely change the rules.....and yes, they can do it.
