In continuing my research yesterday, speaking with both the US DoJ and AZ Dept of Health Svcs., I determined that the opposite was true. since our facility will be neither publicly funded nor open to the public, ADA does not apply.

The previous tenants were there 2 years (homeowners in another area, relocated for temporary work requirement) and never had any issues with the property, and never anything with the kitchen.The current tenants have never been homeowners and are younger, so their experience with what a landlord should fix out of preference vs what they are required to fix out of obligation is probably a gray area for them.I am simply trying to verify that this repair request is a preference and not a legal requirement for health/sanitation or safety reasons.

I have a rental available and was contacted by a New Jersey (NJ) organization called Bridgeway Community Partners in Mental Health aka Bridgeway Rehabilitation Services.It sounds like they send out their own inspector to ensure habitability of the property and then they pay for security deposit and monthly rent until tenant gets on their feet.
