IF you are the owner of the LLC it does not trigger the due on sale clause (Per conversations I have had with my CPA) and if the lender asks you can always move it back or provide proof that you own the LLC.

Just run a simulated income statement on each unit and if the numbers work and you are satisfied with the potential return, pull the trigger.

The first deal is always the hardest one to pull the trigger on, but this will get you acquainted with real life expenses, profits, and problem solving.

I've been listening to PodCasts, reading books and browsing this site for quite some time and STILL have not pulled the trigger on anything yet.   

Sad to hear your purchase is what triggered the neighbor to sue for the PRE-EXISTING encroachment; as if it wasn't a problem 'til now'.

It's unfortunate we have to be concerned about the long term health of IL.Like the other posters said, if you can get out and not have to take a huge hit on tax implications and closing costs AND be a lot happier about your investments... then pull the trigger.  

Costs to get a relinquished property ready for sale are not on the permissible list, so roof repairs would trigger taxable boot.
