I assume your name (or a business where you are a member/principal) is listed as 'buyer', along with an explicit right to assign the contract.The 'easy' way to assign the contract is to have a one page document stating that for some consideration, the 'buyer' transfers/assigns the contract to a new 'buyer'.

I have 2 days to make a decision.On top of this, realtor is asking about $3600 on assorted fees (short sale admin fee, processing fee, document prep fee, courier fee, settlement fee etc etc etc) on top of the commission.From reading BP on various SS threads, there is not much room for negotiation because the amount was determined by BPO right or wrong and the decision to accept or reject is not a human decision but some formulaic thing - unless you can justify it with some major overlooked issues, correct?

Sometimes something as simple as being a day late with the rent is enough to void the option.I'd recommend paying an attorney a couple of hundred to review the documents and make sure they're balanced and that you understand your rights and obligations under the lease and option.An option can be recorded.

There's a few problems with this - first is that the lender will want to know where the mysterious $10K came from and assuming you tell the truth, they will make your friend sign a letter to the effect of "Tia never has to repay this money it is 100% a gift".If he's comfortable doing that, then he obviously trusts you because as soon as he signs that document you have no legal obligation to ever repay.As for the terms - why would you want to buy a duplex and only essentially "own" one unit?
