The government has had to pass extra legislation to keep gay marriage from being legalized (Defense of Marriage Act, 1996), and basically outlawing gay marriage is just tell individuals who they can and can't sign a particular contract with.

After all, that is the last line of defense with regards to collecting rent so they have to be a sure thing.
