I'm getting a little tired of even bothering talking about this, and Bill Gulley has talked at length about it, if you are financing an option or if you're playing a rent credit toward the option fee or down payment, this is a financing arrangement, which the Safe Act and the Dodd Frank act is involved with.If it is investor to investor, Dodd Frank and Safe Act do not apply, So if I'm talking to a landlord wants to sell on terms to me as an investor, and I want to sell and rent to own with rent credits, the Dodd Frank and the safe act apply.Using a lease and a ROFR (right of first refusal) is not an option and does not come under Dodd Frank and the Safe ACT

If the property is vacant, it depends of the length of vacancy and the risk for the location.Safeco insured a vacant house of ours for one year and then wanted to cancel.
