This is the important section of the law that I think you need to go to a title company with:"(3) “Equity conveyance†means a transaction that involves:(a) The transfer of an interest in a residence in foreclosure by an equity seller to an equity purchaser, or to another person acting in association with the equity purchaser, that allows the equity purchaser or other person to obtain legal or equitable title to all or part of the residential real property; and(b) A subsequent conveyance, or agreement for a subsequent conveyance, of an interest in the residential real property from the equity purchaser or other person to the equity seller to allow the equity seller to possess the property during, or after termination of, the foreclosureprocess."

It looks like they've transferred a huge number of derivatives into an FDIC insured subsidiary, with the government's permission:http://www.bloomberg.com/news/2011-10-18/bofa-said-to-split-regulators-over-moving-merrill-derivatives-to-bank-unit.html

How do I protect myself from the US Government?

I think it depends on your economic outlook and the weight you're willing to put behind your beliefs. Not to open up another argument, but as an example, if Manuel truly believes that an economic collapse is inevitable within the next top 10 year (and for anyone else who believes this), I really don't understand why there is any other option besides cashing in everything you have, transferring your net-worth to another currency and moving to another country. On the other end of the spectrum, for those that believe the status quo (not necessarily today's conditions but the "typical" economic conditions of this country) will continue indefinitely, I see no reason to change any course from where it previous has been, assuming you believe that course was previously correct. Now, I guessing, many are like me in their belief that the economic landscape is changing -- perhaps not catastrophically, but certainly non-trivially.

How can an Indian citizen buy real estae in US?

Get a tourist visa, fly to the USA, pick something out, and wire the money to pay for it.You get a tax number from the bank that will receive the money.Interview property managers while you are there. An escrow company handles the transfer on the west coast. On the east coast, you will probably use a real estate lawyer.Money goes to the escrow company, not directly to the seller.Be sure to purchase title insurance.
