If you and your agent think your right just don't sign the release.. the buyer for sure is not going to sign the release to you.. so its just a stalemate..the title company will hold the funds until such time as they interplead it to the court .. then you both hire attornies.. and fight it out.but in the meantime most folks would come up with a win win for this and split the money in some fashion ( assuming your correct that this buyer was out of contract and defaulted)

In the worse case scenario, that its a bad deal and you walk away - then the investor would be stuck with the property OR lose the 10% right?

Tenants come back with sob story about how short notice is due to upcoming deployment (they are moving across town, wife is staying here during deployment, no military documentation provided)Move out date is accepted; if they want out that bad I don't want to force them to stay for fear of damagesBy CA law we can withhold 13 days of rent from their deposit due to insufficient notice to vacate.
