This almost always means that he checking account holder has had numerous insufficient funds, deposited bogus checks, etc., and the bank , as a consequence is placing 10 day holds on their deposited checks.

The only way a property goes back to lien holder is two ways: either at public auction where lien holder is high bidder OR borrower signs deed in lieu of foreclosure.

If you want "clear title" then you would but I do Sub2 and AITDs often enough to know that they are easily possible if all parties agree.There is a deed recorded and the buyer does become the title holder in these transactions, too.
