@Scott BridgehouseUnless the lender stipulates differently in their documents (like VA financing that requires owner occupany for the duration of the mortgage), 'owner occupancy' requires that you move in within 60 days and retain it as your primary residence for 12 months. 

If I sell am I just paying full capital gains tax or does any type of exclusion or proration lower that?

We have created an rental operating agreement for the partners within the LLC.Do we need to consult with the Lawyer or legal team to finalize the operating agreement, so that when in need that document will act as a legal document towards our LLC for the members.
