You should ask your attorney (I would personally try to find someone that markets themselves as a marijuana business attorney actually) to draft a rental agreement that includes as grounds for eviction any growing, using, selling, possessing or anything else pertaining to cannabis (which a good local RE attorney will know the specific laws of).

To reiterate @Bill S. and again, no lawyer, but this is how we've handled it.If you have a signed lease with the booted tenant, you can't just rent out his place to someone else without regaining possession of the premises.

I believe will still follow thru either way,, I guess my main concern is that if I gave notice to tenants, and buyer takes possession during the 30 day notice period,, and tenant didn't move.. whom would be responsible to follow thru.. the assumption of leases by the buyer would (I think ) make them responsible to do eviction action if tenants fails to vacate..

One count is generally for possession and two count is for possession AND damages.You have 30 days to notify them in writing of your claim against their security deposit.

As per the rules we are supposed to give them a 10 day notice to vacate prior to filing for an order of possession so that the sheriff can then begin the process of eviction.
