I'm not sure if being a normal W-2 employee counts towards this. 

The law/CPA firm that handled the transaction was fairly rude to me when I asked for an estimate of the cost basis, saying that they "provide that information for clients"(I guess that several years of business returns and accounting didn't count as being a client).

I'm afraid that losing the rental income on the property and now having the mortgage count 100% as debt and the HELOC debt will prevent me from getting the refi due to DTI unless I close the HELOC first?  

If so, it is better to make sure you have your i's dotted and t's crossed before writing the check.
