the main difference is if your in the business to lend money your a HML  if your not holding yourself out as a lender have money in your IRA or solo k or just cash and do a few deals  a year with those you know like and trust then that is a true private lender in the vernacular.  

With incentives coming out of the recently passed IRA (inflation reduction act), there's going to be a bunch of new practices coming out of it, but it's still too early to tell exactly what it'll look like.

Many retirement accounts will let you take out a loan against your IRA money.

If these are passive investments, I would look into buying the properties in an IRA, 401K, or HSA.
