I would appeal to reason first, and then I would tell him if he doesn't want to be reasonable then he can figure out how to drive on his 5 foot next to my solid concrete block wall that I'm going to build on my side while I make my own driveway.

Also, there is less of an appeal difference as the sizes get closer (example- It is difficult to prove that two houses, with similar bed/bath counts, but a 50sf gla difference, have a different appeal due to the gla difference alone).
