You can try raising the rent of the criminal, but I doubt that will hold up in court if the original tenant is on a year long lease.

Also, check this guy out, I doubt he would default, but if he did, you might get a gutted house back, thats the indem/agreement, but make sure you could collect for reasonable damages beyond the down payment.
