You can but you would want to wait for a low income year to minimize the tax bracket or even better investigate Dennis suggestion above.What I am suggesting is if you have a self-directed account (IRA or ROTH), I recommend investing in notes backed my real estate with clear title.

You will have to fill out forms and do paperwork, but this will force the state to open an investigation into the contractor and will likely result in them holding a hearing.

Your words could easily be twisted into something they are not, and even if the tenant doesn't win in the end, they'll at least get the eviction stayed because the judge finds just a hint of validity in their argument warranting further investigation at the next court date 30 days down the road.
