@Hugo Zubiate Have you checked property records to verify the property he sold actually belonged to him? 

My CPA says the money is not earned until it's applied to a charge, similar to what you would do with a deposit; you hold it in an account, but it still belongs to the Tenant until it's applied to a charge.

I realize the nuance in the decision making that goes into this but what I'm trying to determine is how to get around 25% down payments for investment properties that will be long-term holdings. 

Should I have them sign some thing saying they are moving everything out and she is officially no longer my tenant once her belongings are taken out?
