IMO, if you get involved with a note dated after the effective date of the SAFE Act (last July) or your state laws as adopted, there had better be a broker's/originators seal on the note......down the road, you could have an illegally originated note!

BUT, to get anything in your favor may be extremely difficult, also depending your state statutes.A lease agreement does not have to be in writing to be effective (with some exceptions), so you offer the premises, the tenant accepts the offer by paying the rent, voila, valid legal contract.Problem here are the terms.

I would be concerned about the slope of the line to the street when they replaced it.If the slope isn't right or they have funky bends in it to go around big roots or above them that's when water and debris can sit and cause constant clogs.About every 3 to 6 months the plumber then has to come out and scope the clean out outside to unblock. If material is with dirt etc. is back up in the toilets or they slow drain or make a gurgling noise with bubbles you could have an issue.Make sure as mentioned before buying you get a plumber to scope it out all the way from the toilets to the main and the street to make sure there is not any issues with slopes or clogs.I have heard many horror stories where a buyer calls the county or city and they say on the phone that everything is fine and after they buy it they get hit with all these costs, fines, etc. If they won't give you something in writing I wouldn't feel comfortable about it but that's just me.So this was an existing line to the street and not a sewer tank that they converted later and hooked to the city or county correct??

Ditto, the fact that by living in one of the units you are not earning a lot of the return as income, but rather as money that doesn't have to be spent on rent/mortgage on a primary residence.I'd love to hear what some of the more experienced guys have to say regarding the tax angle, esp. regarding the effect of you living in one of the units.Anyway, congrats again on what looks to be a great investment!

If surveys are used in your area, that could be a $300-$1000 + expense to verify that the property lines are correct & that the buildings are actually on the property, and title phrase is *really* concerning, because you're effectively required to verify title - which could be an additional expense - with no guarantee the deal will close.

When a foreclosure comes through on my block or when a slumlord's property goes vacant, the city forces his hand to bring the home up to code and clean it up on the outside, which is favorable to my property values and my abiity to rent a unit.
