I was thinking if talks fail with the marketing agent, perhaps leverage my relationship with the acquisition agent to get the marketing agent to up their game; The acquisition agent wont want to lose my repeat business. 

Unfortunately, the Sutton Power station ash ponds are significantly (5x to 6x) larger than the Dan River ash ponds according to NC DEQ Inventory of Duke Energy Coal Ash Ponds and Wilmington is significantly more populated than Eden NC, the site of the Dan River breach. 

Lots of information on this site about screening they might be beneficial.

The risk is in losing your equity when markets adjust.

If you can't find good replacements or if you lose the options on your list and are past the period then let your exchange die.

@Sam Hickey Thanks for the additional info, I was browsing a bit on the USDA site but since their properties are mostly in low population areas I believe that wouldn't be great for downtime getting a tenant in.
