He is considered a squatter and you will likely have to have him evicted legally.

Long story short...the person whose name was on the title was not cooperative and we have since had to take legal measures to do a quiet title action that wont be completed until mid August.

I have all the legal and state paperwork showing myself as the owner of the property.

Would it be breaking some legal structure /protection of my LLC by storing the rentals reserves in an account under my personal name?  

To use this type of contract it would be good to get legal counsel on whether it could be considered a de facto net listing.
