We signed a lease agreement on 12/28/18 and were set to move into a house on 2/1/2019, however on 1/26/2019(the owner had expressed that she decided she wanted to sell the house sooner, about 1 month after signing the lease).

One of the tenants, which was inherited by the previous owner, has been paying rent late consistently (for the past 4 months) and by late I mean at the end of the month (rent is due on the 1st).

There is no risk for the owner of the SPV that holds title to the property, b/c their "investors" have no ownership interest. 

The woman living there is the original owner and advanced in years.

As much as I would love to help this group out, as I have done for other owners/operators, I think this investment opportunity is past the point of saving.

You do not need an LLC for one property with a mortgage.It is a rental property and not your primary residence.If you lived in the house for a couple years first then no need to change the mortgage.You might need to change the house to non owner occupied with your property tax office.Are you going to move back into the house when you get back?

(The sponsor has since said he'll amend it to only apply to homes rented as a vacation rental 200 or more days a year.)A new competing bill would apply the commercial tax rate of 29% to Airbnb properties -- like the first bill -- but only if the home is the third or more property of a single owner.
