Serviceman adjusted dampers and vents (as I instructed tenant to do)....charged $180 (silly tradesmen and yuppies)....tenant was good enough to realize it was his own doing, so he picked up the bill.

Each state will have a different process for release of EM.. in an Attorney driven or closing state the attorneys can make those unilateral decisions to release EM per contract since they are practicing law. and what are the damages who is going to get into an embrolio over 500 buckaroos.out here on the West coast any EM put into a title and escrow company without specific escrow instructions signed by both parties as an addendum to the Purchase and sale contract will need the signature of both parties to release.. no wiggle room there.

In a KAIZEN for a manufacturing process for example, (sorry for nerding out here), a process/work flow is studied to determine areas of waste and in turn develop a procedure and/or work instruction for the job function in an effort to shorten lead times.

You should definitely instruct your tenant to call the police if the disturbance warrants it, each and every time it happens, although don't expect the police to actually do anything other than file a report.

I'm not a lawyer, no legal advice, but if it were my tenants, I'd drop off 3 copies of a release addendum removing him as a tenant, pre-filled with your signature so all it needs is both of theirs listing his removal with instructions to her to give you a copy with original signatures for your files if they complete it.

My reading of the 1099-C instructions is that this form is intended to be used by entities who loan money and is not intended for other types of debt.
