.-: the property was & remains an arms length transaction.-: title to the property would now be assumed by the 401(k) solo due to the default of the note & the subsequent execution of the DIL.:- now the profit from the eventual sale of the property should be held tax free in the 401(k) solo for future disposition.am I Correct ???

Ultimately, if you guys can't agree to anything, and your tenant doesn't cure the current violations, then you are left with two options - 1) Do nothing and let the situation remain as is (not recommended), or 2) Start the eviction process.

Good news for you cracks in granite can be fixed by filling with an acrylic but remember later you need to re-polish it otherwise the crack will remain easily visible.
