You can argue that when the tenant was given access to "water" it worked great and now it doesn't and they owe X dollars for that.And to clarify, what you are doing is writing a poor lease, which leaves you exposed more than it harms the tenant ... and then depending on the unwillingness of your tenant to fight you for what is rightfully theirs, and/or a judge being lazy.  

With office space, you're always exposed to new competition.

Bradley, I think you are better offer going with tile in any areas that may be exposed to lots of water or humidity.  

You also won't expose yourself to potential tenant vs. tenant problems, and are likely to be able to attract a higher class tenant who will take better care of the property.I'm going to respectfully disagree w/ Hattie's advice on asking for a 2 yr. lease.

I still have to supplement with electric and propane heat in the winter but they look better than window units from the outside.  

Your opportunity as the investor will be to run the building better and unlock additional value.Here are some strategies I use to maximize revenue and expose turn-over opportunities.- Begin raising the rent like clockwork on the 1st of the year- Look for violations in the existing lease including pets, people, etc.

That said if your proverbial ducks are in a row, it's not all that difficult to do without exposing yourself to too much risk.
