If you are swapping properties between your name and an LLC etc. then it is not being used properly, especially if funds are being co-mingled (or if title in LLC and loan in your name), then a lawyer will see that and if there is an issue they will go after you.

(If I was a lender my main concern would be equity in the property and strength of borrower - which can be measured in more ways then the all mighty tax return) The alternative documentation and cashflow based stuff that I've seen, which has no government subsidies involved at all, isn't as good as what you have in place (eg, if you swap out the 5.875% for an ARM that probably wouldn't make sense even if you dropped 1% from the rate).

The tenant who wants to sublease would do the work of finding the subletter, and I'd require the subletter to go through the same screening the original tenants did, of course.I suppose the other option is to swap out the potential subletter as a full tenant on the lease.
