I didn't read any statutes except what was mentioned above, but I suspect if you dig a little deeper you'll find that there has to be communication as well as acceptance.I also see avoiding the whole issue if there was a mortgage broker that funded a loan and sold the note at the table to the property seller, a purchase-repurchase situation, or even a portion of the note.

Sure everything appears hunky-dory to the casual tourists in the big tourist areas, but if you dig a little deeper, spend more time there, travel outside the main tourist zones, get to know some locals, read the local newspapers and look into the crime rate or are unfortunate enough to become the victim of a crime, you'll learn quickly that it's actually a legitimately dangerous place to live and do business in.
