Although I should be able to collect any expenses I incurred during the buying process.It is my understanding that specific performance is the norm when buying and cash settlement when selling.

As we were going through this process, we assumed that we would not be doing a complete re-paint of our home since in the original settlement it only covered affected areas, which is less than 1/3 of the home and our house was painted less than 3.5 years ago with approved colors (we still have the official “approval” from the HOA/Architecture Review Committee).

Seller paid closing costs are usually called a "seller concession" and appear on the settlement statement as amounts paid by seller for buyer.Your assumption would be correct for the buyer in #2.

In settlement, when the option is taken, the fee paid is a "Paid out of closing" expense, just like an inspection fee might be or an appraisal fee.
