If she does not pay you, I would play it by the books and issue the proper letters in the described timelines to start the eviction notice.

Under the law, I have the right to enter given that she's always been provided proper notice and all visits have been for maintenance repairs and inspections.

Your accountant takes it off the depreciation role and your schedule E and it becomes your primary residence.  

We both signed it  without a proper TREC approved amendment, and there's no date on the HOA addendum.
