Most LL's don't work under that statute if they can help it.  92.055 requires notice sent to the local health authority and T, but can only take possession if there's a provision in the lease that allows. 

COVID is not comparable to the pain caused by our national health problem, heart disease.

Cigar shop if smoking can cause huge issues with filtration leeching into other tenants units.That tenant might also not be a good match for the center if other tenants are more health related as might be off putting to existing tenants customers.Existing tenants that have been there awhile and paying are more stable cash flow then new tenant coming in typically because they have no history of performing at that location.

I've contemplated doing a promote - where both partners get a pro-rata return on their investment until their original equity is returned and then having 60% go to me and 40% to my partner.
