Since we will be closing on our current investment in the next 3 weeks I have asked a few times to start the investigation process for the next property with the thought that would not be a problem.

Where I'm at in Texas my local bank does notes for 15% down payment and I can use the 15% down for rehab process as long as it meets certain criteria.

I have no money of my own and in the process of refinancing my personal home.  

I had one of the tenants, sign a 7 day notice on the off chance they would pay.Today is the last day to pay and I haven't heard from them, except for a text message from a relative of theirs saying that I needed to let them pay late or they would drag out the eviction process.

If they are an experienced investor who is also coaching and mentoring you through the process and not just providing capital than I would say a 30/70 split isn't crazy either.
