This is right off the NC legislation page for process of lis pendens-A copy of the notice of lis pendens shall be served upon the owners and parties in interest in the building or dwelling at the time of filing in accordance with G.S. 160A-428, 160A-445, or 153A-368 as applicable.

The developer (and Association) would need to give the members an opportunity to reject the proposed budget.

Sorry in advance for the long post...I have a family member with a home in Calgary Alberta that she would like to sell but given the hit to the housing market due to dropping oil and gas prices she doesn't want to sell now and take a loss, but doesn't she want to rent it indefinitely (the last time she did this she missed her opportunity to sell when the market was hot 2 years ago because she had tenants in place with a year long lease--well those same tenants renewed the lease in the spring and have now just broken the lease due to lay offs and leaving her high and dry)I proposed a lease option for her but need guidance on the numbers.It's a large luxury home in an A neighborhood but it's 33 years old and needs about $50,000 in work (paint, reinforce retaining wall, replace windows, etc etc)Her monthly payments are $2500.

This practice robotically continues on tens of thousands of home sales each year not because it is all legal or mandated but "because it can" and our legislators dodge the issue at the cost of millions to home owners.The first fee is an HOA Transfer fee retained by and amount determined by the HOA Property Manager (Community Association Manager (CAM)).

Then again, if the agent "wasn't too thrilled" as opposed to simply telling you "no way" in reaction to your proposed contract, they may not be very sharp.

I recently received a loan proposal from an American financial LLC - somehow there are things that do not match on my humble opinion.

I would be a little alarmed if a seller proposed that to me - concerned there is an ulterior motive.  

Sounds like they all just want their money and have different things they want to do with it.Your proposal seems to be a real long shot with no upside to them.

Honestly, my property is about their only option to expand and stay close to their main building.I want to make a proposal, but like I've stated, I'm not sure of where to start or who to ask.
