It sounds really absurd but true.I have heard about the title insurance endrosment but not sure why they could not get an affidavit from us declaring we will not declare this property as homestead in the future.

It sounds like you already decided for yourself: sell it and sleep at night.The other alternative is to refinance to a longer term so it will cash flow, though by how much with these high interest rates is tbd.
