Now with many notes bearing interest rates well below market rate, and with the technology to easily and inexpensively ferret out title transfers, we may see lenders take a more aggressive stance on this issue.The two biggest problems with a subject to property purchase is that the seller is liable for a loan secured by a property he no longer owns and the buyer now holds title to a property with a note where the corresponding mortgage has an act of default.

It’s a little bit convoluted, so bear with me while I lay the foundational information.Owner of record is an LLC (that was administratively dissolved in 2010) whose sole officer/manager died two years ago (2010) and has a living spouse, with whom I have made amicable contact since last year late November, when the same property was listed for imminent sale last December 2012.

Removing walls in these old buildings can involve a lot of effort - even walls that were not originally load bearing may have become so as the house settled over time {remember, lath-n-plaster walls are very heavy}.

First, please bear in mind that a default on our platform does not necessarily indicate that there will be a loss on that investment - in fact, the majority of defaulted loans on our platform repay in full, often with a higher interest rate than expected.

The "standard protocol" according to the lender is that the online notary is valid on U.S. soil, not overseas.I have two buyer clients under contract now who live abroad, and they are both being advised to have the title company draw up a POA once they're under contract that's specific to that real estate transaction, and have it notarized ASAP and mailed back to the states so a colleague/family member in the states can sign their closing docs for them.
