You would incur a capital loss which is suspended because it is to a related party and then you would have a gift to your brother in the amount of FMV minus discounted purchase price which you would pay tax at the estate tax rate (which shoots up to 45% in seconds) or reduce your estate tax exemption (which would affect your estate taxes when you pass on).You are going to have to structure this properly to get around taxes and follow the plan accordingly, but more information with numbers would be required to develope a proper plan.Joe
