State law probably specifies minimum notice required, and if lease was done by a RE Agent or Attorney, would guess it complies with applicable state laws.

(see @Eamonn McElroy post above) If the laborer isn't the owner or employee of a company you hire then it looks like they are your Employee which means you need at a minimum Workers Comp, payroll and associated taxes to comply with the law - Bummer right?

(you could possibly have to give 1 more notice that way you are showing the court you tried to get the resident to comply) As for the smoke smell this would be very hard to prove.
