This way there's no cash out of his pocket that he was counting on receiving.It's important to keep in mind that he has/will probably perform a service or go above the scope of work without charging for it, such as when an unforeseen issue arises during a repair or when he shows up and takes care of something promptly on very short notice.

I'm a little confused about the term "subject to" when it comes to non performing 2nd mortgage workouts.I've been learning about various workout scenarios possible with non performing 2nd mortgage's and I see you can indeed forclose on the borrower from the 2nd position, subject to the 1st mortgagage.
