The issue here is that with investment rates as they are, I'd have to put more down (25% vs 20%) and then I'd be left with a long road to rebuild or repay that downpayment before I could repeat.

If your lease is not written with that clause, you can still try to bill the tenant but you might lose if they challenge it and it goes to court.The maximum fine is determined by state laws and then may be further restricted by HOA bylaws.
