I used a real estate investor lawyer here where i live and he had all the ready document that i needed, so i would advice to do the same. you can even add or delete closes once you have the "base" draft

I'm not sure how it works in your state, but real estate is usually appraised with an effective date being the date of death.

IMO, if you get involved with a note dated after the effective date of the SAFE Act (last July) or your state laws as adopted, there had better be a broker's/originators seal on the note......down the road, you could have an illegally originated note!

BUT, to get anything in your favor may be extremely difficult, also depending your state statutes.A lease agreement does not have to be in writing to be effective (with some exceptions), so you offer the premises, the tenant accepts the offer by paying the rent, voila, valid legal contract.Problem here are the terms.
