There is a 2% exception provision to capitalization, which is the one that I use more than any other.I believe it provides that if all repairs in a year are less than 2% of your unadjusted cost basis in the property you don't need to capitalize.

You're question is better answered by a lawyer which handles landlord/tenant litigation on a daily basis - and yes, there are plenty of instances in which a Landlord and especially a PM (which has a responsibility to an additional party - the owner) will be held liable for non-action.

I wouldn't give them a break on the rent, but I would work out a payment plan where they pay part of the rent and pay back the rest on a monthly basis.
