I plan to build a stronger and stronger presence in that market as time goes on, so it makes sense to me, to just start the LLC now so I can start building a name for the company, seeing as I won't be physically there very much.

The property has to go through probate first, then the probate court action will transfer title from the parents to the legal heirs.Once the heirs have legal ownership, they can close a sale.BTW: Probate has nothing to do with the presence or absence of a mortgage loan.
