You've got your answer above, but you COULD do an exchange if you put the property in to service and held it for a period of time. 

Which means they can only offset any other passive income or up to $20,000 in active income (phases out based on AGI).

I’d love to learn about other people have done that were actually successful and what made them successful  you should only invest in something that you have some understanding of, especially if it is active - which owning real estate is.

States often have their own rules and regulations regarding tax filing requirements.Even if you have a loss, you may still need to report the financial activity from your rental property to the state for tax purposes.

It looks like a larger company without the personal service or communication.I would expect more canned responses, slow responses, slow reactions to get service etc.

I am scratching my head as to whether the property is sold and the listing services aren't updated, or the broker is just plain lazy and doesn't care.

I'll probably call my credit card company and tell them they defrauded me and refund me money to cancel the transaction since they are not providing the service they promised they would. any other course of action recommendation from bp members would be greatly appreciated?
