We have the worst taxes in the nation for everything.It was suggested to me that I should create an LLC and on the application there is an option to choose to be taxed as a S or C corporation.

To get here, it took me 15 years at a corporate job saving and living life.  

At the present time if you offered me a deal I wouldn't take it unless I contracted directly with the other party and you would need to trust me on your getting paid.Now with my kids wanting to do this we formed a legal entity, didn't have LLC's back then so we used land trusts and for some deals a corporation.

FWIW, I do know one person who attacked California corporations on a regular basis.

Doing so would only save them a fee one time, but the loss to them on any future deals and their namesake would be a great loss.Also, in an effort to avoid such an occurance, I have in the past had escrow instructions that instructed escrow to payout on the Hud (irrevocably) to pay my corporation the fee amount and make sure that my fee plus the EMD required was sent into escrow upfront by the buyer BEFORE they could ever do such a thing.

It isn't like you expect them to say something before they run to code enforcement or the local fair housing organization.Why not hide behind a corporate entity and claim that, "I'm not the owner, this LLC is"?

No the "Agent" does not have to necessarily be the "Resident Agent" for an LLC or Corporation.
