At any time after the loan is made (3 years or not) the borrower may bring this as a defense in set off to any foreclosure action and recover the previous 3 years of payments!!

State of Oregon has some nice people working there and if you do things by their rule your fine step over the line and you will be down in Salem in a heartbeat defencing yourself and I can tell you as a Oregon RE broker.. the act of putting a home you do not own on craigs list and representing that you are the seller is a licensed activity and you have no defense..State of ORegon went very hard after private lenders that were making loans with out NMLS license ( of which I am one of those as well) Oregon requires NMLS license for any loan on 1 to 4 regardless of who borrows or what purpose..

This thread is a little old, but thought I would jump in.I'm currently signed up on the a program which gives me access to the training platform until the next conference being hosted.I do not directly work in sales, I run the maintenance end of a property management company.I would say that one month on the program, using techniques taught on the platform, I have almost doubled my productivity.

Your sole defense (if it applies), is the seller did not disclose the condition to me AND it was not discovered in the title/permit search during escrow.Deals are everywhere and if these are the only ones your finding, IMO SHOP ELSEWHERE
